Definitions
In this Agreement, "Action Humanitarian" means the organization conducting the trip. "Participant" means the adult volunteer or minor volunteer identified in this Agreement. "Released Parties" means Action Humanitarian, its affiliated organizations, directors, officers, employees, volunteers, trip leaders, agents, contractors, donors, sponsors, local partner organizations, host-property owners, and transportation or activity providers involved with the trip, together with each of their respective representatives, successors, and assigns. "I" and "me" mean the adult Participant signing this Agreement or, for a minor Participant, the parent or legal guardian signing this Agreement, except where a section expressly refers to the minor.
Covered Trip and Activities
This Agreement applies to the Action Humanitarian Philippines volunteer trip scheduled for November 5-15, 2026, and to all related travel, service projects, lodging, meals, meetings, transportation, excursions, recreational activities, and incidental activities before, during, or after the trip (collectively, the "Volunteer Activities"). The Volunteer Activities may include international and domestic air travel; travel by van, automobile, ferry, and boat; walking on uneven or unfinished surfaces; construction, repair, cleanup, lifting, and use of hand or power tools; interaction with local residents, volunteers, animals, and unfamiliar environments; swimming, snorkeling, beach and water activities; and optional recreational activities.
Acknowledgment and Assumption of Risks
I understand that international travel and the Volunteer Activities involve known and unknown risks that cannot be eliminated. These risks include, without limitation: vehicle, aircraft, ferry, and boat accidents; unsafe or changing road, weather, ocean, and worksite conditions; falls; cuts; burns; strains; tool or equipment injuries; drowning; illness; food- or water-borne disease; insect- or animal-borne disease; allergic reaction; communicable disease; limited sanitation; crime; theft; civil unrest; terrorism; natural disaster; delay or cancellation; separation from the group; language or cultural barriers; and delayed, unavailable, or lower-standard medical care and emergency evacuation. Injury, illness, permanent disability, property loss, and death are possible. I understand and voluntarily accept these risks for myself and, when I am signing as a parent or legal guardian, in deciding to permit the minor Participant to take part. To the fullest extent permitted by law, I assume the risks that apply to me, including risks arising from the acts or omissions of other participants, local partners, independent vendors, or the ordinary negligence of a Released Party.
Independent Travel and Activity Providers
I understand that airlines, ground transportation companies, boat operators, lodging providers, guides, medical providers, and other vendors may be independent parties that Action Humanitarian does not own or control. Schedules, routes, accommodations, activities, and local conditions may change without notice. Action Humanitarian does not guarantee the acts, safety, equipment, facilities, or services of an independent provider.
Health, Fitness, and Safety Responsibilities
I am responsible for deciding, in consultation with a qualified health professional when appropriate, whether the Participant is physically and medically able to participate. I am responsible for the Participant's required travel documents, vaccinations, medications, prescriptions, allergy information, mobility needs, and other personal health precautions. I will promptly tell a trip leader about any condition or limitation that may affect the Participant's safe participation or emergency care. The Participant will follow safety instructions, use required protective equipment, remain with the group when directed, comply with local law and custom, and stop an activity if the Participant cannot participate safely. If the Participant is a minor, I will make reasonable efforts to ensure the minor follows these requirements.
Emergency Medical Care and Evacuation
If the Participant is unable to make or communicate a medical decision, I authorize the Released Parties to obtain or arrange medical, dental, hospital, transportation, rescue, or evacuation services that they reasonably believe are appropriate for the Participant. I understand that this authorization does not require any person to provide or arrange care and does not guarantee that care or evacuation will be available or timely. I accept financial responsibility for medical treatment, transportation, evacuation, medication, and related costs incurred for the Participant, except to the extent another person or insurer is legally responsible.
Insurance, Personal Property, and Trip Changes
I am responsible for confirming whether the Participant's health, travel, evacuation, cancellation, and personal-property insurance is adequate for the Philippines and the Volunteer Activities. Unless Action Humanitarian expressly confirms coverage in writing, I will not assume that Action Humanitarian provides insurance for the Participant. I accept responsibility for the Participant's passport, money, luggage, electronics, and other property. I understand that weather, safety, government action, vendor decisions, illness, or other circumstances may require changes, delays, cancellation, or early termination of all or part of the trip.
Conduct and Removal from Activities
The Participant will act respectfully, avoid illegal, unsafe, harassing, abusive, or disruptive behavior, and follow reasonable directions from trip leaders. Action Humanitarian may restrict or end the Participant's participation when it reasonably believes doing so is necessary for safety, legal compliance, the welfare of the group or community, or the mission of the organization. If participation is restricted or ended because of the Participant's conduct or failure to follow instructions, I am responsible for resulting transportation, lodging, change, or return-travel costs.
Release, Waiver, and Covenant Not to Sue
PLEASE READ THIS SECTION CAREFULLY. In consideration for being permitted to participate, I, for myself and for my estate, heirs, personal representatives, and assigns, release and discharge the Released Parties from, waive, and agree not to bring any claim or lawsuit for personal injury, illness, disability, death, property damage, economic loss, or other loss arising out of or related to the Volunteer Activities, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, to the fullest extent permitted by law. This release does not apply to gross negligence, reckless conduct, willful or intentional misconduct, or any liability that applicable law does not permit to be released.
Indemnification for My Conduct
To the fullest extent permitted by law, I agree to defend, indemnify, and hold the Released Parties harmless from third-party claims, damages, judgments, losses, and reasonable costs, including attorney fees, that arise from my negligent, reckless, or intentional acts; my violation of law or safety instructions; or my material breach of this Agreement. This provision does not require me to indemnify a Released Party for that party's gross negligence, reckless conduct, willful or intentional misconduct, or other liability that cannot lawfully be shifted.
Governing Law, Venue, and Severability
This Agreement is governed by the laws of the State of Utah, without regard to conflict-of-law rules, except where another law must apply. Any claim that may lawfully be heard in Utah shall be brought in a state or federal court of competent jurisdiction in Utah, and I consent to personal jurisdiction there. If a provision is held invalid or unenforceable, it will be narrowed to the minimum extent necessary and the remaining provisions will continue in effect.
Entire Agreement and Voluntary Signature
This Agreement contains the entire understanding concerning the matters it addresses and may be changed only in a writing accepted by Action Humanitarian and the person signing. I acknowledge that no oral statement has changed the terms of this Agreement. I have had sufficient time to read it, understand that it affects legal rights, have had the opportunity to ask questions and seek independent legal advice, and sign voluntarily without pressure or reliance on statements not contained here.
Certification
I certify that I will be at least 18 years old on November 5, 2026. I have read this entire Agreement, understand its terms, and knowingly agree to the assumption of risk, release, waiver, covenant not to sue, indemnification, medical authorization, and other provisions above.
